BURNAID TERMS AND CONDITIONS

1. ACCEPTANCE OF TERMS

These Terms and Conditions (“Terms”) govern access to and use of the BurnAid website, mobile applications, web applications, software, reports, content, and related services (collectively, the “Services”).

By accessing, downloading, registering for, subscribing to, or using BurnAid, you agree to be bound by these Terms, the BurnAid Privacy Policy, the BurnAid Disclaimer, and any applicable subscription, licensing, data processing, institutional, or enterprise agreement.

If you do not agree to these Terms, you must not access or use the Services.

2. DESCRIPTION OF SERVICES

BurnAid is a clinical reference, assessment, documentation, and calculation-support platform designed to assist qualified healthcare professionals with adult and pediatric burn-care scenarios, including:

  • Burn assessment
  • Burn area mapping
  • Total Body Surface Area (TBSA) estimation
  • Medication dose calculation support
  • Fluid resuscitation calculation support
  • Nutritional calculation support
  • Clinical reference information
  • Clinical reporting
  • Historical assessment review
  • Related burn-care support functions

BurnAid is intended solely as a professional reference and support tool. BurnAid does not replace professional medical judgment, specialist consultation, institutional protocols, local standards of care, or applicable legal and regulatory requirements.

3. ELIGIBILITY

BurnAid is intended for use by:

  • Licensed healthcare professionals
  • Healthcare institutions
  • Hospitals and clinics
  • Medical universities and training institutions
  • Authorized healthcare staff

BurnAid is not intended for direct use by patients, children, parents, guardians, or the general public.

Users are responsible for ensuring that their use of BurnAid complies with all applicable laws, regulations, licensing requirements, professional obligations, and institutional policies.

4. PEDIATRIC USE CLARIFICATION

BurnAid may be used by qualified healthcare professionals as a clinical reference, assessment, documentation, and calculation-support tool for both adult and pediatric burn-care scenarios.

Pediatric patient-related information may be entered only by qualified healthcare professionals or authorized healthcare staff as part of clinical assessment and report-generation workflows.

Healthcare professionals and healthcare organizations remain responsible for obtaining any required patient, parent, guardian, institutional, or legal consents or authorizations, and for ensuring compliance with applicable pediatric healthcare, privacy, consent, and institutional requirements.

5. CLINICAL RESPONSIBILITY

BurnAid is a clinical reference, assessment, documentation, and calculation-support tool only.

Users acknowledge and agree that:

  • BurnAid does not diagnose medical conditions.
  • BurnAid does not prescribe treatment.
  • BurnAid does not establish a practitioner-patient relationship.
  • BurnAid does not replace professional medical judgment.
  • BurnAid does not replace specialist consultation, institutional protocols, local standards of care, or emergency clinical judgment.

All clinical decisions remain solely the responsibility of the treating healthcare professional. This includes responsibility for:

  • Diagnosis
  • Treatment planning
  • Medication selection
  • Dosage verification
  • Fluid management
  • Nutritional management
  • Patient monitoring
  • Clinical documentation
  • Clinical outcomes

Users must independently review, verify, validate, and interpret all outputs, calculations, references, summaries, and reports generated by BurnAid before use in patient care, documentation, handover, or clinical decision-making.

6. ACCOUNT REGISTRATION

Users may be required to create an account to access certain features.

Users agree to:

  • Provide accurate and current information.
  • Maintain the confidentiality of login credentials.
  • Promptly update account information.
  • Notify BurnAid of unauthorized account access or suspected security issues.

Users are responsible for all activities occurring under their accounts.

7. SUBSCRIPTIONS AND PAYMENTS

BurnAid may offer:

  • Free plans
  • Trial plans
  • Individual subscriptions
  • Institutional subscriptions
  • Enterprise licensing arrangements

Subscription pricing may vary by:

  • Country
  • Region
  • Institution
  • User category
  • Currency
  • Subscription type or plan

Users agree that:

  • Fees may be charged in different currencies.
  • Applicable taxes may be added.
  • Subscription plans may automatically renew unless cancelled in accordance with the applicable subscription terms.
  • Currency conversion rates may be determined by payment providers, app stores, or financial institutions.
  • BurnAid may modify pricing, plans, features, and service offerings from time to time.

Unless required by applicable law or expressly stated in the applicable subscription terms, fees paid are non-refundable.

Where BurnAid is purchased through a third-party app store or payment platform, additional terms of that app store or payment platform may apply.

8. PERMITTED USE

Users may use BurnAid solely for lawful professional, educational, research, institutional, and clinical reference purposes.

Users shall not:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Services.
  • Attempt unauthorized access to BurnAid systems, accounts, data, or infrastructure.
  • Introduce malicious software, scripts, code, or harmful content.
  • Interfere with or disrupt system operation, security, or availability.
  • Copy, reproduce, modify, resell, sublicense, distribute, or redistribute proprietary content without authorization.
  • Use BurnAid for unlawful, unsafe, deceptive, or unauthorized activities.
  • Misrepresent BurnAid outputs as independent medical advice or as a substitute for professional clinical judgment.
  • Use BurnAid in a manner inconsistent with these Terms, the Privacy Policy, the Disclaimer, applicable laws, or institutional policies.
9. PATIENT INFORMATION AND HEALTHCARE PRIVACY

BurnAid is designed to minimize the collection, storage, and retention of patient-identifiable information wherever reasonably practicable.

Patient names, hospital-assigned identifiers, and medical record numbers may be processed during active assessment and report-generation workflows. BurnAid is designed not to retain direct patient identifiers in stored historical assessment records after completion of the assessment and report-generation process.

Users remain responsible for:

  • Patient confidentiality.
  • Obtaining required patient, parent, guardian, institutional, or legal consents or authorizations.
  • Compliance with healthcare privacy laws and institutional policies.
  • Accuracy and appropriateness of information entered into BurnAid.
  • Protection, storage, retention, transmission, printing, downloading, exporting, or sharing of reports containing patient information.

Where BurnAid processes protected health information or similar regulated health information on behalf of a healthcare organization, hospital, clinic, covered entity, business associate, or similar regulated entity, additional contractual terms, data processing terms, or business associate terms may apply as required by applicable law.

10. REPORTS, REFERENCES, AND CALCULATIONS

BurnAid may generate:

  • Burn assessment reports
  • TBSA calculations
  • Medication dose calculation-support outputs
  • Fluid resuscitation calculation-support outputs
  • Nutritional assessment calculations
  • Clinical reference information
  • Clinical summaries

Such outputs are generated based on user-entered information and predefined methodologies.

BurnAid does not guarantee that any output is complete, accurate, error-free, suitable, current, or appropriate for any specific patient or clinical situation.

All outputs, calculations, references, summaries, and reports must be independently reviewed, verified, validated, and interpreted by the treating healthcare professional before use in patient care, documentation, handover, or clinical decision-making.

11. INTELLECTUAL PROPERTY

All intellectual property rights relating to BurnAid remain the exclusive property of BurnAid and its licensors.

This includes, without limitation:

  • Software
  • Algorithms
  • Source code
  • Databases
  • Reports
  • Content
  • Graphics
  • Trademarks
  • Logos
  • Documentation
  • Design elements
  • Calculation methods and workflows to the extent protectable by law

No ownership rights are transferred to users.

Users receive only a limited, non-exclusive, non-transferable, revocable license to access and use the Services in accordance with these Terms and any applicable subscription or licensing agreement.

12. USER CONTENT AND INPUT DATA

Users are solely responsible for the accuracy, completeness, legality, appropriateness, and clinical relevance of all information entered into BurnAid.

BurnAid outputs depend on user-entered information. Incorrect, incomplete, outdated, or inappropriate input data may result in incorrect or inappropriate outputs.

Users are responsible for reviewing and correcting all input data before relying on any BurnAid-generated output.

13. THIRD-PARTY SERVICES

BurnAid may utilize, integrate with, or link to third-party services, including:

  • Cloud hosting providers
  • Payment processors
  • Analytics platforms
  • Communication services
  • Infrastructure providers
  • Security and monitoring services
  • App stores or distribution platforms

BurnAid is not responsible for the performance, availability, security, privacy practices, content, or terms of third-party services.

Users should review the applicable terms and privacy policies of third-party services separately.

14. SERVICE AVAILABILITY

BurnAid is provided on an “as available” basis.

We do not guarantee:

  • Continuous availability
  • Error-free operation
  • Uninterrupted access
  • Compatibility with all devices, browsers, operating systems, or institutional systems
  • Availability in all jurisdictions
  • Availability of all features at all times

Maintenance, updates, outages, security events, third-party service interruptions, and technical issues may affect service availability.

15. UPDATES AND CHANGES TO SERVICES

BurnAid may modify, update, suspend, discontinue, replace, or remove features, functionality, pricing, subscription plans, content, workflows, reports, calculation methods, or service offerings from time to time.

BurnAid may also release updates, patches, corrections, improvements, or new versions of the Services. Continued use of the Services after changes become effective constitutes acceptance of the updated Services and applicable terms, unless otherwise required by law.

16. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, BurnAid is provided “as is” and “as available.”

BurnAid disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties relating to:

  • Accuracy
  • Reliability
  • Availability
  • Completeness
  • Timeliness
  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

No warranty is made that calculations, references, reports, summaries, or outputs will be error-free, current, complete, suitable, or appropriate for any particular clinical situation.

17. LIMITATION OF LIABILITY

To the fullest extent permitted by law, BurnAid, its owners, affiliates, licensors, employees, contractors, officers, directors, agents, and representatives shall not be liable for any direct, indirect, consequential, special, incidental, punitive, exemplary, or other damages arising from or related to:

  • Use of or inability to use the Services
  • Reliance upon BurnAid outputs, calculations, references, summaries, or reports
  • Clinical decisions or patient care decisions made by users
  • Medication selection, dosage verification, or administration
  • Fluid management or nutritional management
  • Treatment outcomes or patient injury
  • Data loss or unauthorized access
  • Service interruptions, delays, errors, or outages
  • Third-party services, payment providers, app stores, or external systems
  • Loss of profits, loss of data, business interruption, reputational harm, or loss of goodwill

Where liability cannot legally be excluded, BurnAid’s total aggregate liability shall not exceed the fees paid by the user to BurnAid during the twelve (12) months immediately preceding the event giving rise to the claim, unless a different limit is required by applicable law.

18. INDEMNIFICATION

Users agree to indemnify, defend, and hold harmless BurnAid and its owners, affiliates, licensors, employees, contractors, officers, directors, agents, and representatives from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising from or related to:

  • Misuse of the Services
  • Violation of these Terms
  • Violation of applicable laws, regulations, professional obligations, or institutional policies
  • Clinical decisions made by users
  • Patient care provided by users
  • Unauthorized or improper use, disclosure, storage, transmission, or sharing of patient information
  • User-entered information, exported reports, or reliance on BurnAid-generated outputs without independent clinical review and verification
19. SUSPENSION AND TERMINATION

BurnAid may suspend or terminate access to the Services if:

  • Users violate these Terms or related agreements.
  • Fraudulent, abusive, unsafe, or unauthorized activity is detected.
  • Required fees are not paid.
  • Continued access presents security, legal, operational, privacy, or regulatory risks.
  • BurnAid is required to do so by law, regulation, court order, governmental request, or institutional requirement.

Users may terminate subscriptions in accordance with applicable subscription terms. Termination does not relieve users of payment obligations incurred before termination or responsibilities relating to exported reports, patient information, confidentiality, or prior use of the Services.

20. EXPORT COMPLIANCE AND SANCTIONS

Users agree not to access or use BurnAid in violation of applicable export control laws, sanctions regulations, trade restrictions, or other legal restrictions.

Users are responsible for ensuring that their access to and use of BurnAid is lawful in the jurisdiction from which they access the Services.

21. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of India.

Subject to applicable law, any dispute, claim, or proceeding arising out of or relating to these Terms, the Services, subscriptions, payments, user accounts, reports, calculations, or use of BurnAid shall be subject to the exclusive jurisdiction of the competent courts located in Ernakulam, Kerala, India.

Nothing in this clause shall prevent BurnAid from seeking urgent injunctive, equitable, or protective relief in any court of competent jurisdiction where necessary to protect its intellectual property, confidential information, security, systems, or legal rights.

22. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid, illegal, or unenforceable provision shall be interpreted, modified, or replaced to the maximum extent permitted by law to achieve its intended purpose.

23. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Disclaimer, Data Processing Addendum where applicable, Business Associate or similar healthcare privacy terms where applicable, Subscription Agreement, License Agreement, Order Form, and any other applicable written agreement, constitute the entire agreement between the parties relating to the Services.

In the event of a conflict between these Terms and a separate written agreement signed or accepted by BurnAid and a customer, the separate written agreement shall control to the extent of the conflict.

24. CHANGES TO THESE TERMS

BurnAid may revise these Terms from time to time to reflect changes in legal requirements, technologies, business practices, or BurnAid services.

Updated versions will be posted within the Services or on the BurnAid website with a revised “Last Updated” date. Continued use of BurnAid after such changes become effective constitutes acceptance of the revised Terms, unless otherwise required by applicable law.
